समुदाय अपनी सामाजिक व्यवस्था के सफल संचालन हेतु अनेक रीतियों व प्रथाओं का निर्माण करता है। साथ ही समुदाय अपने सदस्यों को लोकनिंदा एवं सामाजिक बहिष्कार के शस्त्र का भय दिखाकर इन प्रथाओं के पालन हेतु विवश करता है किंतु जब इस शस्त्र का प्रयोग समाज के प्रभुत्वशाली वर्ग द्वारा निर्बलों के विरुद्ध दुर्भावनापूर्ण तरीके से किया जाता है तो यह अपराध की श्रेणी में आता है। भारत सहित विश्व के विभिन्न पिछड़े देशों में इस शस्त्र का प्रयोग निर्बलों के विरुद्ध अपनी प्रभुता की स्थापना हेतु किया जाता है। पश्चिमी उत्तर प्रदेश एवं हरियाणा की खाप जाति पंचायतों के सामाजिक बहिष्कार के अमानवीय फैसले सदैव समाचार-पत्रों की सुर्खियों में रहते हैं। भारत में सामाजिक बहिष्कार का सर्वाधिक शिकार अनुसूचित जाति, जनजाति व महिलाएं हैं। शनैः-शनैः संपूर्ण देश में सामाजिक बहिष्कार जैसे अमानवीय प्रथा के विरुद्ध जागरूकता का प्रसार हो रहा है। महाराष्ट्र की विधान सभा ने देश में सर्वप्रथम सामाजिक बहिष्कार के विरुद्ध 11 अप्रैल, 2016 को सर्वसम्मति से विधेयक पारित किया है। जिसके तहत सामाजिक बहिष्कार को कानूनी अपराध घोषित किया गया है।

• महाराष्ट्र विधान सभा ने 11 अप्रैल, 2016 को सर्वसम्मति से सामाजिक बहिष्कार (रोकथाम, निषेध और निवारण) अधिनियम, 2016 पारित किया।
• इस विधान के प्रमुख बिंदु निम्नलिखित हैं-
• इस विधान के तहत किसी व्यक्ति या व्यक्तियों के समूह द्वारा किसी व्यक्ति या जाति पंचायत जैसे पंचायत द्वारा सामाजिक बहिष्कार को निषिद्ध किया गया है।
• इस अपराध में संलग्न आरोपियों को सात वर्ष की कैद या 5 लाख रुपये का जुर्माना या दोनों का आरोपण हो सकता है।
• इस अपराध में सहायता प्रदान करने वाले को तीन वर्ष की कैद या 3 लाख का जुर्माना या दोनों का आरोपण हो सकता है।
• सामाजिक बहिष्कार के पीड़ित पुलिस के माध्यम से शिकायत दर्ज कराने के साथ-साथ सीधे दंडाधिकारी को अपनी शिकायत दर्ज करा सकते हैं।
• विधेयक के तहत अपराध को संज्ञेय तथा जमानती घोषित किया गया है।
• विधेयक के अंतर्गत आरोपियों पर आरोपित आर्थिक जुर्माने की राशि पीड़ित को दिया जाएगा।
• आरोप-पत्र दाखिल होने के पश्चात छः महीने के अंदर सुनवाई पूरी होनी चाहिए ताकि आरोपियों को शीघ्र सजा मिल सके।
• सामाजिक बहिष्कार जैसी घटनाओं को रोकने के लिए निषेध अधिकारी नियुक्त किया जाएगा। जो ‘सामाजिक बहिष्कार निषेध अधिकारी’ के पद नाम से जाना जाएगा।
• विधान के तहत कोई अपराध नहीं हुआ, इसे सिद्ध करने का भार अभियुक्त पर होगा।

कहा गया है कि किसी कमजोर, जरूरतमंद या असहाय परिवार की कन्या का विवाह करानें से बढ़कर कोई अन्य पुनीत कार्य नहीं है। इस बात का प्रमाण है कि आज हर छोटे-बड़े जिलों, कस्बों या शहरों में कई वैवाहिक संस्थाएं मिलजुकर सैकड़ों कन्याओं के हाथ सामूहिक विवाह के माध्यम से पीले कर रही हैं। जिनमें से कुछ सर्वजातीय वैवाहिक समितियां तथा कई सजातीय संस्थाएं क्रमश: सभी जातियों के तथा अपनी जाति के सामूहिक विवाह में सक्रिय हैं। ये संस्थाएं विवाह जैसे सामाजिक पुण्य कार्य में अपनी सराहनीय भूमिका निभाती हैं। प्रशंसनीय बात यह भी है कि अब इन सामूहिक वैवाहिक कार्यक्रमों में अपेक्षाकृत अच्छी संख्या देखी जा रही है। इन संस्थाओं के बैनरतले शादियां कराने पर समय की बर्बादी, दान-दहेज व फिजूलखर्ची जैसी कुरीतियों से भी समाज को मुक्ति मिल सकती है। लेकिन, इसके लिए जरूरी है कि समाज का बड़ा वर्ग भी इसमें सम्मिलित हो ताकि कोई भी जरूरतमंद व कमजोर परिवार अपनी नजरों में हीन व हास का पात्र न महसूस करे। आज शादी-विवाह समाराहों में खर्च होने वाला अनाप-शनाप पैसा बिल्कुल पानी की तरह बहाया जाता है, जो कहीं-कहीं पर अप्रासंगिक सा लगता है। यह अनावश्यक खर्च फिजूलखर्च की श्रेणी में ही गिना जाता है। आज योग्य वर को पाने के लिए भी दान-दहेज के रास्ते पर चलने से भी नहीं बचा जा सकता है। दहेज के सामान की मांग व मोटी रकम दिये बगैर अच्छा जीवन साथी मिलनाआसान नहीं होता। सबसे पहले अच्छे दूल्हे की बड़ी कीमत होती है, कीमत को चुकाने की स्थिति में ही शादी की बात आगे बढ़ती है। नहीं तो, बात खत्म। अपनी जेब के हिसाब से दूल्हा ढूंढऩा पड़ता है क्योंकि आज दूल्हे खरीदे जाते हैं। कई जगह बड़े या सक्षम लोग अपनी मर्जी से लड़के पक्ष को दान-दहेज से लाद देते हैं। ऐसे लोग समाज में अपनी हैसियत का उच्च प्रदर्शन करते हैं, जिसमें अपना स्टेटस व रुतबा दिखाना भी खास मकसद होता है। अक्सर ऐसा दिखावटी प्रदर्शन विभिन्न वर्गों के बीच प्रतियोगिता का रूप भी ले लेता है। फिर किसी की बराबरी करने के लिए शादी समारोह में अपना भी रुतबा दिखाने के लिए आम आदमी कर्जदार भी बन जाता है। क्योंकि कई लड़कियों की शादी करने में तो पिता की कमर ही टूट जाती है, इस प्रकार विवाह के लिए लिया गया कर्ज बाकी की जिंदगी को भी दुश्वार कर देता है। इन सब स्थिति से बचने के लिए जरूरतमंद परिवार की कन्याओं के खर्च बगैर विवाह के लिए ऐसी संस्थाओं की भूमिका सराहनीय हो जाती है। कुछ वैवाहिक संस्थाएं योग्य वर-वधू हेतु परफेक्ट पेयर मैचिंग के लिए बायोडाटा एक्सचेंज करने का काम भी सुलभ कराती हैं। अपनी मनपसंद दूल्हा-दुल्हन का चयन होने तथा रिश्ता तय हो जाने से विवाह तक की पूरी जिम्मेदारी वैवाहिक संस्था की होती है। सामूहिक विवाह कराने वाले संगठन नव विवाहित जोड़ों को गुजर-बसर करने के लिए घर-गृहस्थी का जरूरी सामान विदाई के समय उपहार स्वरूप भी देते हैं। इतना सब होने पर भी सामूहिक विवाह कराने वाली संस्थाएं प्रचार व प्रसार के जरिये ऐसे परिवारों की खोजबीन में लगी रहती हैं ताकि ज्यादा से ज्यादा जरूरतमंद परिवारों की कन्याओं का विवाह कराया जा सके। परंतु, देखने में यह भी आता है कि अपनी लड़की की शादी आदि के लिए व्यवस्था-इंतजाम आदि न कर पाने पर भी कुछ परिवार सामूहिक विवाह में आने से कतराते है। इसका एक दूसरा पहलू भी हमारा समाज है, क्योंकि इन्हें समाज का डर भी सताता है कि अपने लोगों के बीच कहीं हंसी की बात न हो जाये। हमारे समाज की विडम्बना भरी विचारधारा यह भी है कि सामूहिक विवाह केवल निम्न वर्गों के लिए ही उपयुक्त है। क्योंकि जिनके पास शादी आदि के लिए खर्च की व्यवस्था नहीं है, वही लोग इसका लाभ लेने के योग्य हैं। जबकि सच यह है कि किसी समाज का निर्माण सभी वर्गों के एकसाथ समाहित होने पर ही होता है। दिखता यह है कि ऐसे सामूहिक सामाजिक विवाह समारोहों में बड़े वर्ग की हिस्सेदारी व सहभागिता नगण्य सी है। मध्यम वर्ग के लोगों के आयोजनों में आने से निश्चित तौर पर जरूरतमंद परिवारों की संख्या में और भी इजाफा होगा। सजातीय वैवाहिक संस्था से जहां पर जाति-विशेष को बल मिलता है, वहीं पर सर्वजातीय विवाह कराने से समाज की ताकत भी मजबूत होती है। सामूहिक विवाह का फायदा यह भी है कि इससे अनावश्यक खर्च की बचत के साथ दबावग्रस्त दान-दहेज देने की मजबूरी से भी छुटकारा मिल सकता है। जहां पर शादियों में दहेज एक अभिशाप है वहीं पर विवाह आदि पर किया गया अनाप-शनाप खर्च समाज के विभिन्न वर्गों के बीच हीन भावना भी पैदा करता है। सामूहिक विवाह को बढ़ावा देने तथा अन्य वर्गों को जागरूक करने की हम सबकी सामूहिक जिम्मेदारी भी बनती है। सामूहिक विवाह समाज में सामाजिक एकता व जागरुकता लाता है।

Because they cannot afford the expenses. One of the organization takes the responsibility of all the expenses.

गरीबों की शादी कराना महान कार्य है। समाज में अपनी बहन बेटियों की शादी करना तो हम सबका पारिवारिक दायित्व है परंतु किसी और की बेटी और खासकर गरीब की बेटी के हाथ पीले कर एक साथ ज्यादा से ज्यादा घरों को बसाना एक महान यज्ञ के समान है । इस प्रकार के सामाजिक कार्यों के लिए हम सबको खुले हृदय से आगे आना चाहिये ।

सामूहिक विवाह सम्मेलन वर्तमान की आवश्यकता -- क्या समाज के संरक्षक स्वयं आगे आएंगे।

सम्मेलन की ही तरह सामूहिक विवाहों के आयोजन किए जाना समाज के लिए अच्छा कदम हें। इस कार्यक्रम के माध्यम से जो धन, झूठे सामर्थ्य प्रदर्शन व्यय होता हे वह, नई दम्पत्ति के लिए उन्नति का सहारा हो सकता हे। कुछ लोग कह सकते हें की हम इस विवाह व्यय का बोझ उठाने में समर्थ हें। वे यह क्या यह भूल जाते हें की इससे असमर्थ व्यक्तियों पर मानसिक दवाव बनता हे। वे भी अपनी पुत्र या पुत्री के लिए सक्षम परिवार में रिश्ता करना चाहते हें, इस लिए सामुहिक विवाह को नहीं अपना कर, अन्य पक्ष की इच्छा या मानसिकता के आधार पर सामर्थ्य से अधिक व्यय कर आर्थिक बोझ के नीचे दव जाते हें। ओर यह भी हे की कोई भी स्वयं को असमर्थ या कमजोर ,गरीब साबित नहीं होने देना चाहता, चाहे इसके लिए कुछ भी क्यों न करना पड़े, कितना भी कर्ज क्यों न लेना पड़े।

नव जवान युवक ओर युवतियों से आज यह आशा की जा सकती हे, की इन बातों को वे समझ कर अपने परिवार को सामूहिक विवाह के लिए तेयार कर सकते हें, ओर अपने पालको को इस धन की बरबादी से बचा कर कर्ज के खड्डे में, गिरने से बचा सकते हें। यही बात दूसरी ओर भी लागू होती हे की क्या कोई जमाई यह चाहेगा की उसके ससुराल पक्ष को एसी कठिन परिस्थिति का सामना करना पड़े। यदि कोई जमाई एसा चाहे तो वह जमाई बनाने लायक हो ही नहीं सकता, लालची जमाई ओर परिवार में कोई बेटी सुखी हो ही नहीं सकती।

सामूहिक विवाह जेसी सामाजिक गतिविधि को आगे बड़ाने, ओर उसके लिए किसी को भी तैयार करने की कोशिश करने वाले महानुभवों को अक्सर यह ताना मिलता हे की स्वयं ने तो सामूहिक विवाह नहीं अपनाया पर हमको शिक्षा दे रहें हें। पर भाई यदि उनसे भूल हो गई हे, ओर वे इसी बात को समझ कर आपसे अनुरोध कर रहे हें, तो क्या आप बात को समझ कर भी सबक नहीं लेंगे? क्या जब तक आप स्वयं की हानी न हो जाए अनुभव से सबक नहीं लेंगे ?

अनुभव में आया हे, की सामर्थवानों के द्वारा अपनाए किसी भी कार्यक्रम को अन्य सभी शीघ्र स्वीकार कर लेते हें, क्या अब वक्त नहीं हे की सभी सक्षम भी अपने पुत्र- पुत्रियों के सामूहिक विवाह में उनका विवाह कर समाज का नेत्रत्व करें। वे सम्पन्न होने के साथ साथ हर तरह से सक्षम भी हें। "महाजनौ येन गता सुपन्था" अर्थात बड़े व्यक्ति जिस राह पर चलते हें वही सच्चा मार्ग हे, के इस शास्त्र वचन को सार्थक कर हम ब्राह्मण अर्थात सर्व श्रेष्ठ होने की बात सार्थक करें।

सामूहिक विवाह के आयोजन से केवल स्वयं का धन ही नहीं बचता, देश की संपदा, के साथ व्यर्थ श्रम ओर बहुत सारी परेशानियों से भी छुटकारा मिल जाता हे। यह सब श्रम पूरा समाज मिलकर कर लेता हे।

कुछ विशेषकर नवजवानों का यह सोच होता हे की हम परिवार सहित विवाह में बहुत मजा [सेलिब्रेट] करेंगे, पर मित्रो क्या एसा हो पाता हे, परिवार के सारे सदस्य तो व्यवस्था स्वागत सत्कार में जुटें होते हें, ओर थक कर चूर हो जाते हें, आने वाले अपना स्वागत करवाने/ ओपचारिक उपस्थिती/आशीर्वाद दे कर ओर अच्छा केवल भोजन कर जाने की इच्छा रखते हें। इनमें से किसी भी प्रकार की कमी उनकी असंतुष्टि बनकर "कटाक्ष" जो सबको कष्टकारी होती हे का कारण बन वैमनस्य का बीजारोपण भी करती हें।

हमारे प्राचीन शास्त्रो में भी सोलह संस्कारों में से कुछ संस्कार जिनमें यज्ञोपवीत जो शिक्षा का प्रारम्भ, विवाह जो ग्रहस्थ जीवन का प्रारम्भ, से लेकर अंतिम संस्कार तक के सभी संस्कारों को पूरे समाज के कार्यों से जोड़ा गया हे। इन्हे सारे समाज को मिलकर करना होता हे। विवाह के अवसर पर सारे समाज द्वारा दी जाने वाली भेंट का मूल उद्देश्य भी यही हे। ओर सामर्थ्य अनुसार पित्र संपत्ति से पुत्री को मिलने वाला स्त्रीधन जिसे कालांतर में विक़ृत 'दहेज' के नाम से जाना जाने लगा, इसी व्यर्थ प्रदर्शन ओर अमर्यादित अहम के झूठे प्रदर्शन से उत्पन्न हुआ हे, ने ही विवाह रूपी पुनीत कार्य जिस पर संतानों का भविष्य टिका होता हे को दूषित कर दिया हे। क्या यह समाज के सभी सक्षम जिम्मेदार बड़े कहाने वाले अग्रणी महानुभवों का कर्तव्य नहीं की वे समाज का सच्चा नेत्रत्व करें, ओर नई चेतना उत्पन्न करें। उन्हे आगे आकर आज अपने पुत्र ओर पुत्रियों का विवाह सामूहिक विवाह सम्मेलन में करना ही होगा, अन्यथा करनी कथनी का फर्क समाज को नष्ट कर देगा।

निवेदन हे की समय रहते जागें, उठें , ओर सारे समाज को उठाने में योगदान करें, अपने पुत्र-पुत्रियों/ पोते-पोतियों को सामूहिक विवाह में शामिल कर समाज के वास्तविक संरक्षक बने।
