Complaint against the PIO for refused to accept the application fees and
deliberately and wrongly refused to give information. It is gross violation as
per the provisions of the RTI Act.
Dear Sir,
I
am a RTI & social activist. I have been using the RTI Act for larger public interest and have made
representations at various levels against corruption, illegal encroachment,
illegal factory units & irregularities within the MCD & other
departments for seeking information to
promote transparency and accountability in the working of every public
authority of India.
I
want to draw your kind attention that the CPIO of DSIIDC ltd. has refused to
accept the application fees and deliberately and wrongly refused to give information.
It is gross violation as per the provisions of the RTI Act.
I had filed an RTI application on 05/03/2013
with DSIIDC Ltd. seeking some information. The CPIO has replied vide letter
No.DSIIDC/CWC/RTI/2012-2013 dated 22-03-2013 to me and returned the RTI
application on the ground of “the said
IPO is not paid to anyone and is left blank”. (Attached PIO’s letter
photocopy).
I
had again filed fresh same RTI application on 06/04/2013 with DSIIDC Ltd.
seeking some information. The CPIO has reply dated 30-04-2013 to me and
returned the IPO on the ground of "the
account section has refused to accept the said IPO as it is outdated. Thus, you
are requested to send the fresh IPO or you may deposit Rs. 10/- in cash. So,
that, your application may be entertained." (Attached PIO’s letter photocopy).

I want to inform that
the validity of an Indian postal order is 2 years from the date of issue as per
D. O. No. 15-6/88-PO of dtd. 25-09-1995. The CPIO has violated provisions of Section
5(3) of the RTI Act. (Attached photocopy order Ministry of
Communication).
I had submitted 300 plus previous RTI
applications along with same date IPO's in different departments. But none of
the PIO objected on this matter. The CPIO has refused to
accept the application fees and deliberately and wrongly refused to give
information as per the provisions of the RTI Act.
Therefore,
I humbly request you to pass orders to the said department to accept my RTI
application & fees and taking action against the PIO/Department head impose
a monetary fine.
I
am attached return Indian Postal Order with this complaint.

The IPO is valid for a period of 2 years. The IPO can be renewed beyond this period of 24 months, for an additional 1 year, by paying the commission amount. If an Indian Postal Order is not presented for payment within twenty four months from the last day of the month of issue a second commission at the rates prescribed will be charged which must be paid in postage stamps affixed to the back of the order. Those authorized to use them may pay the second commission in Service Postage Stamps. Indian Postal Orders presented for payment more than 36 months after the last days of the month of issue will not be paid but will be forfeited.
