Pvt school, govt get court notice

New Delhi, June 2, 2012, DHNS:
Explain admission denied to poor student: HC
A private school in Delhi, the Directorate of Education and Delhi government have been served notice by the High Court to explain why a student from a financially weaker background was asked by a school to discontinue his studies.

Yuva Shakti Model school in Rohini, north west Delhi, had denied admission to a seven-year-old in class 2 even though his UKG and LKG studies were completed in the same school.

Parents alleged that the school is forcing them to pay fees when he has been studying under the Economically Weaker Sections category since the beginning.

The court has asked the school to give a reply by July 9 on the petition filed by the student’s father. Justice Hima Kohli, who was hearing the plea issued the notice to the government and the school on Friday.

Advocate Ashok Agarwal, appearing for the student, argued that Kailash had been studying under the EWS category since 2009 and the school had stopped him from attending classes since April.

School’s action
“The action on the part of the school was arbitrary, illegal, unconstitutional and violative of the Right of Children to Free and Compulsory Education Act, 2009,” said Agarwal.
The petition urged the court to direct the government to take action against the school as it is violating rules even under the Delhi School Education Act.

“The school is situated on public land allotted by the Delhi Development Authority on concessional rates, with the condition that it will admit at least 25 per cent children belonging to the weaker sections,” added Agarwal.
