About the case:
The Social Jurist by this PIL [Social Jurist vs. Government of NCT of Delhi and others, CW.3156/2002
(Delhi H. C.), Date of filing: 17.05.2002, Status: Decided on 20.01.2004] have highlighted the facts that
there are more than 1500 unaided recognized Private Schools in Delhi and more than 1200 of these schools have been allotted public lands on throwaway prices. It is submitted that one of the objects behind it was that such schools discharge their social obligation to provide free education to a certain percentage of children of poor through their schools. It is also submitted that in case of most of these schools, an express condition that they shall ensure admission to the children belonging to weaker sections to the extent of 25% and grant freeship to them exist in the land allotment letters. However, in some cases though it has been
said in the allotment letters “That the society shall ensure that percentage of free ship from tuition fees as laid down under the rules is strictly complied with” but rules have not so far framed either by DDA in Delhi Govt. in this regard leaving such school to exploit the situation against public interest. It is submitted that the authorities have obtained an undertaking from all these schools at the time of allotment of land to the effect that they will ensure admission to the children of weaker sections to the extent of 25% and grant them free ship.
It is submitted that none of these schools has complied with the aforementioned condition of land allotment and the authorities are totally insensitive and apathetic towards the rights of poor, as they have not taken any action against such erring schools. It is submitted that impugned actions/inactions of the respondents are adversely affecting the fundamental rights to education of the children of the poor which are guaranteed to them under Article 21, 38, 39 (c) & (f), 41, 45, 46, 51 (b) & (f) read with Delhi School Education Act, 1973, Universal Declaration of Human Rights (1948) and UN Convention on Rights of the Child (1989).

The petitioner submit that all the unaided recognized private schools in Delhi to whom public land have been allotted on throwaway prices are violating the conditions of land allotment as no school is providing free education to the children of the poor. It is also submitted that the public authorities have not taken any action against the erring schools for failure on the part of such schools to comply with the terms and conditions of land allotment. It is submitted that the growth of private school has widened the gulf between the classes and masses, which is opposed to the letter and spirit of the constitution of India. It is submitted that the provision of free education to the children of the poor as stipulated in the allotment of land letters, if implemented, will go long way to goals set out in the constitution. The Kothari Commission (1964-66) in its report noted:-
“1.36 The Common School. In a situation of the type we have in India, it is the responsibility of the educational system to being the different social classes and groups together and thus promotes the emergence of an egalitarian and integrated society. But at present instead of doing so, education itself is tending to increase social segregation and to perpetuate and widen class distinctions. At the primary stage, the free schools to which the masses send their children are maintained by the government and local authorities and are generally of poor quality. Some of the private schools are definitely better; but since many of them charge high fee, they are availed of only by the middle and the higher classes. At the secondary stage, a large proportion of the good schools are private but many of them also charge high fees which are normally beyond the means of any but the top ten per cent of the people, though some of the middle class parents make great sacrifices to send their children to them. There is thus segregation in education itself – the minority of private, fee charging, better schools meeting the needs of the upper classes and vast bulk of free,
publicly maintained, but poor schools being utilized by the rest. What is worse, this segregation is increasing and tending to widen the gulf between the classes and the masses.
1.37 This is one of the major weaknesses of the existing educational system. Good education, instead of being available to all children, or at least to all the able children from every stratum of society, is available only to a small minority which is usually selected not on the basis of talent but on the basis of its capacity to pay fees. The identification and development of the total national pool of ability is greatly hampered. The position is thus undemocratic and inconsistent with the ideal of an egalitarian society. The children of the
masses are compelled of receive sub-standard education and, as the programme of scholarships is not very large, sometimes even the ablest among them are unable to find access to such good schools as exist, while the economically privileged parents are able to `buy’ good education for their children. This is bad not only for the children of the poor but also for the children from the rich and privileged groups. I gives them a short-term advantage in so far as it enable them to perpetuate and consolidate their position. Bit it must be realized that, in the long run, their self-interest lies in identifying themselves with the masses. By segregating their children, such privileged parents prevent them from sharing the life and experiences of the children of the poor and coming into contact with the realities of life. In addition to weakening social cohesion, they also render the education of their own children anemic and incomplete.”
The petitioner submit that Law Commission of India in its 165th report on free and compulsory Education for children amongst other dealt with the question of free education to the children of the poor in private schools. It proposed “Free and Compulsory Education for Children Bill, 1998” In Section 12 of the said Bill, it was suggested that: “Section 12: -Every recognized school shall impart free education to twenty per cent of the students admitted to any class up to and inclusive of eighth standard. The students in this category shall be admitted by the school in consultation with the parent-teacher association and the concerned local authority from among the children of the poorer strata of society of the village or locality who are not able to afford the fee and other charges levied by the school.”
The petitioner submit that every child of this country has a fundamental right to receive free and compulsory education up to 14 years and in case of child with disability up to 18 years and this right is an independent right of the child and does not depend on the economic and other status of his/her parents. In terms of Article 51A of the constitution of India, it is the duty of every citizen to strive towards excellence in all spheres of individual and collective activity so that the nation constantly rises to higher levels of endeavor and achievement. It is submitted that Delhi School Education Act, 1973 provides for free education up to 14 years of age and Person with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 provides free education to the children with disabilities up to 18 years.
The petitioner submit that all unaided recognized private schools in Delhi irrespective of the fact whether public land has been allotted to them or not, should provide free education to the children of the poor to the extend of 25% as a part of their social and moral duty towards the children of the poor. It is submitted that where public lands have been given to the private schools on throwaway prices, such schools have a legal obligation to provide free education to the children of the poor to the extend of 25% and incase they fail to discharge the said obligation, the public authorities are legally bound to take action against such erring
schools.
The petitioner sought directions against the public authorities to identify all such unaided recognized private schools in Delhi to whom the lands have been allotted by public bodies at concessional rates/free of cost and to place on record of the Court list of all such schools with relevant particulars thereof; to ensure that all Unaided Recognized Private Schools in Delhi to whom public lands have been allotted on concessional rates/free of cost should comply with the conditions of allotment of lands in regard to admission to the children of weaker sections of society to the extent of 25% and grant free ship to them; to take action
against the erring schools; to frame rules/policy laying down provision for admission by all unaided recognized private schools in Delhi to whom public lands have been allotted on concessional /free of cost to children belonging to weaker sections of society to the extent of 25% where the specific condition of free education to children of the poor up to 25% has not been incorporated in the allotment letter and to initiate high level enquiry to find out the names of the person/authorities who are responsible for their culpable acts of not ensuring the adherence of the conditions of allotment of lands to such private schools and permitting
such private schools to cheat children of the country by not providing them free education under the conditions of the allotment of land.
Delhi Government and the DDA have filed their replies shifting their obligations on each other. The DDA in its affidavit-dated 13.08.2002 submitted that one of the conditions mentioned in letter of allotment is that the school/Society shall give free studentship to 25% of the student from weaker sections of the locality. The Govt. of NCT, Department of Education is mainly responsible for the supervision/monitoring the Schools/Society to whom it grants recognition to School & recommendation for allotment of plot of land for the purpose of School. The Govt. of Delhi in its affidavit-dated 21.02.2003 submitted that they do not have any control over the terms and conditions fixed by the DDA for allotment of land. In fact, for violation of those terms and conditions, the DDA should cancel the lease or charge the schools the market rates.
The High Court (B.C. Patel C.J. and Badar Durrez Ahmed J) by judgment dated 20.01.2004 held, “ Thus, it is very clear that 25% of the students belonging to poor sections are entitled to get admission and free ship in such schools. However, it would be for the Directorate of Education to investigate the matter and to point out to the DDA wherever a breach is committed. If there are no rules for admission framed in this regard, it would be for the Directorate of Education to see that the rules are framed so that the weaker sections of
society may not suffer. It is hoped that within a period of four months this exercise shall be carried out and, after the DDA is informed, it will be the duty of the DDA to take appropriate action against any school committing breach of the condition. A compliance report be filed by the Directorate of Education after four months. With these directions, the petition stands disposed of.”
Comments
Will the Court Order be really implemented? This is currently a hot issue being debated all over the country. The decision of the High Court though limited to the unaided recognized private schools in Delhi who have been given public lands on throwaway prices but the same seems to be a radical step in bringing a change in educational scenario throughout the country. It is of course difficult but not impossible to get it implemented in its true spirit. Had the Government of Delhi interested in ensuring compliance of the condition of land allotment by these schools, the Social Jurist would not have filed the PIL in the High Court. The government, no matters, which political party runs it, has always seems to be on the side of school mafias. The masses are served with only lip services.
The Court by its Order of January 20, 2004 had given four months time to the government to carryout exercise of investigating the matter pointing out to the DDA wherever the breach is committed, but the process of such exercise was not started though a period of nearly three months has passed. The current academic session started from April 01, 2004. The government had not published so far the names and addresses of the schools obliged to provide admission/freeship to the students belonging to weaker sections. In the absence of such information, the students who were desirous to avail the benefit did not know to which schools they could apply. After all the efforts to persuade to government to act failed, the Social Jurist again approached the High Court for directions. The High Court on April 21,2004 directed the government to prepare the list of the identified schools with in a period of one week and soon thereafter the public at large should be informed that in particular schools, particular percentage of admissions are reserved for certain categories. It is only after these directions from the Court, the government came in action and published on 27.04.2004 in all the daily Delhi newspapers the list of as many as 142 schools, which according to the government have committed breach of the condition of allotment. The government on
27.04.2004 also issued an order detailing the following directions: -
“1. All schools will grant minimum 20% freeship (which includes Tuition Fees, PTA or any other fees/funds/charges of any kind related to teaching-learning) to the children of the weaker sections of society w.e.f. 1st of May 2004.
2. While making admissions, every 5th student is to be admitted from weaker sections of the Society. The annual parental income from all sources shall form the basis of admission in the schools. The qualifying parental income charges from time to time and the same will be notified from time to time by the Department of Education. However, the present annual parental income limit is Rs. 48,000/- for boy students and Rs. 60,000/- for girl students. Further, the parents of the child should have been staying in Delhi for last 5 years. Adequate poof like ration card or electoral identity card or driving licence or birth certificate of child etc. should be insisted on in this regard.
3. The income certificate in respect of parents will be issued by S.D.M. of the area or any other Revenue Officer not below the rank of the Tehsildar or Food & Supplies Officer, Department of NCT of Delhi.
4. In case of a child who has studied in an un-recognized school, provision of Rule 141 (1) of
the Delhi School Education Rules, 1973, would be applicable.
5. No registration fee including charges of prospectus, if any, will be charged from any of the students belonging to the weaker sections.
6. The admission to entry level, in respect of seats reserved for students belonging to the weaker sections, will be done by draw of lots in the presence of concerned parents, DDE or his nominee not below the rank of Vice-Principal of the government school. The system of draw of lots would be adopted only if registration exceeds more than the prescribed limit reserved for such students.
7. For admission in a class beyond entry level, the admission test will be held in the first week of April and the selection of students will be done based on relative grading, in case the registration exceeds the prescribed limit.
8. All schools will notify another date for inviting applications for admission, in case the registration in any class is below the prescribed limit.
9. No school shall withdraw any exemption from the payment of fee etc. granted to any student belonging to the weaker sections of the society without prior approval of the Director.
10. No school will refuse acceptance of the application for admission from any student belonging to the weaker sections of the society.
11. There shall be no hike in the fees/funds/charges for other students on the plea of grant of freeship to the students belonging to the weaker sections of the society.
12. Every unaided recognized private schools, shall in compliance of Rule 180 of the Delhi School Education Rules, 1973, submit returns and documents in the following prescribed proforma to the Director of Education by 31st day of July of each year: -
(i) Budget estimates of receipts and payments of ensuring year.
(ii) Final Accounts i.e. receipts and payment account, income and expenditure and balance sheet of the preceding year (duly audited by the Chartered Accountant).
(iii) Enrolment of Students as on 30th April.
(iv) Pattern of concessions/scholarship, etc. (this pattern of concession would also include list
of children being granted freeship in pursuance of this order.
(v) Staff statement.
(vi) Schedule of fees/fines/funds, etc.
(vii) Statement showing the dates of disbursement of salaries.
Non-compliance of the above order will be viewed very seriously and strict action besides
withdrawal of recognition/stoppage of aid shall be taken against the erring schools.”
