RTE: Education Dept showcauses 3 schools

Chandigarh After maintaining a three-month silence, the UT Education Department today woke up to the issue of denial of admission to underprivileged children by privateschools. The Department has served a two-day showcause notice to three schools against whom written complaints have been received.
These include Vivek High School (Sector 38), St Kabir School (Sector 26) and Delhi Public School (Sector 40). “We are examining the matter. We have already served notices to a few schools asking them to explain the cause of denial. A meeting was held with officials to decide on the further actions,” said DPI (Schools) Sandeep Hans.

While the officials refused to provide the exact number of complaints received against each school, sources confirmed that out of 20, the maximum number of complaints have been filed against St Kabir (15). “The school refused to provide me the application form, stating that there are no seats lying vacant. The guard did not even let me enter the school,” reads the application of Anita Verma (name changed), a Sector 27 resident who wished to apply in St Kabir school for her child’s admission.
A parent from Bapu Dham colony, Sadhu Ram (name changed) seeking admission in the same school, wrote, “When we went to seek admission, the school authorities told us that there were no vacant seats.” When contacted, St Kabir School Administrator Gurpreet Bakshi said, “The Department has written to us about the complaints. But all these complaints are false. No such parent has visited us till date.”

Delhi Public School Principal Reema Dewan said, “We have not refused admission to any eligible applicant. Only those applications were rejected where the applicant either did not meet the age criteria or submitted inadequate documents.”
The Department has also sought replies from six other schools against whom telephonic complaints have been made. An official from the Department said that most of the parents ringing in at the Education Department over the last week complained that they were denied entry into the school.

As per the public notice issued by the Department last week, a total of 470 seats were lying vacant in 38 schools. Of these 13 were vacant in St Kabir, 22 in Vivek High School and 11 in Delhi Public School. The RTE Act makes it mandatory for all private schools to reserve 25 per cent seats in the entry class for underprivileged children.

Independent Schools Association (ISA) President and Vivek High School Director H S Mamik said, “The Department has not made any efforts to bring clarity on the eligibility or reimbursements to be paid to schools. If they have not done their bit, how can they expect us to implement the RTE Act and admit more children. They have not notified the per-child-expenditure till date.”

PU hikes EWS scholarship
CHANDIGARH: Panjab University Vice-Chancellor R C Sobti on Tuesday announced an increase in the amount of scholarship provided to students belonging to economically weaker sections (EWS). For category I, the amount has been increased from last year’s Rs 6,000 to Rs 10,000. For category II, it has been increased to Rs 7,500 from Rs 5,000.

SC admits PIL seeking exclusion of affluent SC/STs from reservation quota


The Supreme Court has agreed to hear a petition seeking exclusion of advance and affluent Castes/Tribes of SCs and STs from the purview of reservation policy.

A Bench of Justices R.V. Raveendran and A. K. Patnaik has issued notices to the Centre and state governments seeking their response to introduce concept of creamy layer for SC and ST reservation, according to TOI.

The Bench passed the order while hearing a 100 page petition filed by a former Bureaucrat, O.P. Shukla, seeking exclusion of affluent Castes/Tribes of SCs and STs from the reservation quota. The Petitioner himself belongs to the extremely backward Community/Caste among the Scheduled Caste.

The Petitioner states that various Government studies and reports have eventually found that the benefits were not percolating down to the real and genuine beneficiaries. Resultantly, the intent and purpose of reservation or affirmative action for depressed or disadvantaged class stands defeated. 

According to TOI, Advocate Balaji Srinivasan, appearing for the Petitioner, referred to various surveys conducted by state governments pointing out that there were affluent castes within SC and ST.

The Petitioner submitted that the ‘Reservation Policy’ that has been in force for the last 63 years is lopsided and fewer groups are getting the benefits which has resulted in these groups becoming advanced in all social parameters. In other words these groups no longer require benefits of reservation.

The Petitioner further submitted that it is an established fact that various state governments, as well as the Central Government has conducted various studies for measuring the actual beneficiaries of the Reservation Policy. All the Committees have enormously recommended that there should be the periodic review of Scheduled Castes and Scheduled Tribes requiring reservation. 

It is also been found factually that none of the recommendation of these committees has been implemented thereby playing a fraud on the Constitution and also on its citizens. This has resulted in total and complete violation of Article 14, 15 and 16 of the Constitution of India.

The Petition states that as early as 1965, the Lokur Committee recommended exclusion of certain advanced castes/tribes. It was also pointed out by the committee that vested interests had emerged within SCs and STs as a result of concessions given to them. The Petition further stated that the Centre was unjustified in not extending the principles of creamy layer to Scheduled Caste and Scheduled Tribes.

The Petitioner has pleaded that Centre and state governments should be directed to take firm steps to review the scheduled or reservation policy and to implement the Lokur committee’s recommendations and to exclude Chamar, Mala, Mahar, Meena, Dusad Passi and Dhobi etc. from the schedule/list.

The Petitioner further prays that the Court directs the Centre and State Governments for equitable distribution of share of Reservation among 99% Ati Dalit castes so as to ameliorate the sufferings of age old Ati Dalits amongst the SCs /STs.

Till now, creamy layer among OBCs are not entitled to the reservation quota but no such stipulation for the SCs and STs have been made yet. This Petition is an attempt to exclude the creamy layer from SC/ST reservation policy.

Service book of govt servant not personal: CIC

NEW DELHI: In a major decision that could spark privacy versus transparency debate, the Central Information Commission (CIC) has said the service details of a public servant are not confidential and can be provided to an RTI applicant. 

The country's top watchdog had earlier taken out property details and income tax returns of public servants from the ambit of confidentiality which has been challenged in the Delhi High Court. 

The CIC's decision came while hearing the plea of an RTI applicant who had sought from the Railways the service book details of the Chief Law Assistant. The applicant also sought to know if the post of Chief Law Assistant at the Chittaranjan Loco works was a tenure post. 

The application was rejected by the Public Information Officer saying the information contained in the service book of a public servant is personal and exempted from disclosure under the section 8 (1) (j) of the RTI Act. 

"The Commission holds that service details of public servants available in service books cannot be treated as personal information," Information Commissioner Annapurna Dixit held. 

She, however, ordered the disclosure of the service book after severing records which may be personal and exempted from disclosure under the provisions of the RTI Act. 

The section cited by the Public Information Officer exempts information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of privacy of the individual. 

However, if Central Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information then it can be provided.
