Private schools misreport enrolment data to hide income, reveals RTI

Private schools in the city routinely lie about the money they get in the form of school fees, documents obtained through the Right to Information Act have revealed.  

According to RTI replies, schools have been lying about the number of students they admit each year in the annual returns and related documents they file with the Directorate of Education (DoE).

In a large number of cases, schools have not given any details about the admissions done in nursery and kindergarten and have lied about the number of students in class 1.

This means that while schools are getting more money in the form of fees, they are reporting only a fraction of it and transferring the rest to another account.

A school, for example, had 150 students in class 1 in 2012-13 according to the undertaking filed by it but its annual returns said it had only 43. The school misreported the actual number of students even in 2010-11 and 2011-12.

Every year, schools have to submit a copy of their income tax returns to the DOE. In a separate communication on a different date, the directorate had also asked schools to submit an undertaking about the number of students they admitted in pre primary and primary classes.

This is where the trouble for schools began. Even though schools have submitted both documents, the returns have a considerably lesser number of students as compared to the undertaking.

While this means that schools are hiding their real income from fees, it also means that schools have hiked annual fee by giving false information.

A school’s fee structure is decided by a variety of things, of which its annual income is a major part. If a school shows les income, it means they can ask for a bigger fee increase. A healthy bank account means no fee increase of a marginal increase.

After a complaint was made, the Directorate of Education issued a show cause notice to five schools n March 9 asking them to explain their stand. The directorate has also asked other schools to make sure such discrepancies are not seen in the future.

“This matter came to us and after going through the documents we realised that there was a problem. We have given schools a chance to explain their stand. Once we hear them out, a decision will be reached,” said Padmini Singla, director, education.

Activists, however, feel that just a show-cause notice is not enough.

“This data was with the directorate throughout but no one ever looked at it. A thorough inquiry needs to be launched. This is a scam of considerable proportions, especially since there are over 1,000 schools in the city,” said Khagesh Jha, who is the complainant.

नई दिल्ली, प्रेट्र : मान्यता प्राप्त निजी स्कूल सूचना अधिकार (आरटीआई) कानून के तहत शिक्षा निदेशालय से जानकारी देने से छूट का दावा नहीं कर सकते। केंद्रीय सूचना आयोग की पूर्ण पीठ ने अपने फैसला में यह बात कही है। पीठ ने ऐसा एक तरह से उन्हें इस पारदर्शिता कानून के दायरे में लाने के लिए किया है। पीठ ने अपने एक आदेश में कहा, विद्यालय प्रबंधन और संचालन से संबंधित मुद्दे शिक्षा के विकास के लिए इतने महत्वपूर्ण हैं कि उन्हें निजी संस्थाओं की मर्जी पर ऐसे ही नहीं छोड़ सकते। भले ही सरकार से ऐसे विद्यालयों को मदद मिलती हो या नहीं। आयोग ने एक निजी विद्यालय में नियुक्त एक अध्यापिका को नौकरी का रिकार्ड दिखाने का आदेश सुनाते हुए यह टिप्पणी की। राजधानी के पंचशील एन्क्लेव स्थित पिनैकल स्कूल की शिक्षिका बिंदु खन्ना ने आरटीआई के तहत शिक्षा निदेशालय के पास याचिका दायर कर अपनी नौकरी के रिकॉर्ड के बारे में जानना चाहा था। निदेशालय से कई बार आदेश दिए जाने के बावजूद स्कूल ने कहा कि वह एक निजी संस्थान है अत: यह कानून उस पर लागू नहीं होता। विद्यालय ने कानून की एक धारा का भी उल्लेख किया था जिसके तहत उसे व्यक्तिगत जानकारियां नहीं देने की छूट का प्रावधान है। आयोग ने कहा कि दिल्ली विद्यालय शिक्षा कानून-1973 कहता है कि किसी निजी स्वीकृत स्कूल के सभी रिकार्ड निदेशक द्वारा अधिकृत अधिकारी द्वारा किसी भी समय जांच के लिए खुले हैं। शिक्षा विभाग को विद्यालयों द्वारा जो रिकार्ड उपलब्ध कराए जाते हैं उनके बारे में आरटीआई आवेदनकर्ता जान सकता है।

As a group of responsible parents, we want to bring a very serious issue to your notice that the common man is unable to obtain quality school education for their wards, because we suffer from negligence of teaching staff of Salwan Boys Sr. Sec. School, Old Rajinder Nagar, Delhi.

We have been raising their voices for the past 02 years against negligence of teaching staff. Unfortunately, it has become apparent that above these three teachers had not prepared to properly teach students of ninth class. Due to this year Math, SST., & Science subjects results were very poor. Unexpected, failure of IX class 155 students, its results clearly show that negligence of these teachers and legally liable for poor teaching/results.

We want that you act immediately to resolve this matter. In today’s global economy, our students simply cannot afford to lose a year of instruction because of these teachers’ poor performance. Swift action must be taken so our children do not fall any farther behind.

It has been brought to our notice by Kumari Keshwati D/o Suresh Chander Baghel R/o B-187, Galli No. 13, PH-10, Shiv Vihar K-Nagar, Delhi-94, (Ph no: 09718621614) that she has passed Class X CBSE Examination 2010-11 while studying in Sarvodaya Kanya Vidyalaya, Gokulpur village, Delhi-94. Kumari Keshwati has complained that despite the fact that she has passed Class X Examination (Passed in English subject also), the school has denied her admission/promotion to Class XI in Humanities stream with English subject and compelling her to take Sanskrit instead of English. The student is very much mentally disturbed by such illegal and unjust action on the part of the school.

The case of Kumari Keshwati is not the only case in which the school has denied English subject and compelled the student to take Sanskrit subject, but almost all Government schools are doing the same thing causing great prejudice to these young students career. It is submitted that the schools by hook or by crook want to show the highest pass percentage even if it is done at the cost of the career and the life of the students. You will appreciate that Sanskrit has no utility whereas without English, it is almost impossible for a person to survive in this competitive world.

It is, therefore, requested that you may kindly look into this matter and take necessary action ensuring that the students are not unnecessarily harassed by the schools by denying them English subject in Humanities stream.

SUBJECT: Innocent school children in Delhi belonging to the economically weaker sections of the society continue to suffer everyday due to lack of basic facilities like desks, water, electricity, clean toilets, teachers in their schools due to the indifference and negligence on the part of the Government of NCT of Delhi and the Municipal Corporation of Delhi in implementing the Right of children to Free and Compulsory Education Act, 2009
The following problems were highlighted in the Government schools: 
1. Teacher is not there for teaching.
2. Lack of good behavior towards students.
3. Teachers give them work like to cleaning the classroom, benches, ground etc.
4. Teachers beat the students without any reason.
5. School doesn’t give chance to girl’s to play the games in the school.
6. There is no potable water in the school campus.
7. There is no tap or water supply in the school properly.
8. In some schools, there are no benches for students to sit and do studies well.
9. In the absence of the principal, teachers take them (student) away from the class and give them work to clean the school campus.
10 .Whenever students ask any question, the teachers beat them without any reason.
11 .Lack of education and studies in the school.
12 .Toilets are in bad condition.
13 .Teachers give homework to students without making them understand the topic.
14 .Facilities of computer class and science lab are lacking. 
15 .There is no play ground in some schools.
16 .Teachers don’t come to school on time.
17 . Overcrowded classrooms.

The misconduct and negligence on the part of Delhi government and the Municipal Corporation of Delhi is in violation of the Constitutional and the statutory rights of the children to free and compulsory quality elementary education as envisaged in Article 21 (right to life with dignity) and Article 21-A (right to education) of the Constitution of India and in Right of Children to Free and Compulsory Education Act, 2009. We would also like to mention that though the historic Right of Children to Free and Compulsory Education Act, 2009 ensures that children between 6-14 years have access to free and quality elementary education, legislating laws is only half the work done. The government has made a promise to millions of children and it is necessary to ensure that the concerned authorities constantly assess the factors that go into preventing the children from attending school. The government and local authorities are obligated to provide schools, set benchmarks, rules of implementation etc regarding various provisions of the Act. The government has to work towards restoring the sanctity of the childhood of school-going children as well as out of school children, including children with disabilities.

It is understood that the Act aims at those who are not privileged enough to exercise their right to quality education. It has become crucial to inculcate equality in our society where large scale disparity prevails. Therefore, every child is equal before law and all of them should have access to the same quality of education. The responsibility of the authorities does not end at bringing such children to school, the essence of the Act is that they actually attend school and complete their elementary education. It is unfortunate that access to education has been a constant struggle for the unprivileged and disempowered. The State was expected to bring all the children into school within ten years of the commencement of the Constitution but miserably failed. Unnikrishnan’s landmark judgment (1993) of the Hon’ble Supreme Court declaring right to education a fundamental right of every child has never been implemented. Now Article 21-A has been inserted in the Constitution which mandates State to provide free and compulsory education to all the children in the age group 6 to 14 years now that the Right of Children to Free and Compulsory Education Act of 2009 has been passed and come into force w.e.f. 01.04.2010. It is submitted that despite all these legislations and assurances, the children of the masses are continued to be deprived of their right to quality education. The need of the hour is to inculcate an accountability system wherein anyone who disobeys the protocol laid down by the Act will be answerable.

We, therefore, most humbly request you to kindly take cognizance of these postcards and initiate appropriate proceedings against both the State Government and the Municipal Corporation of Delhi to redress the just, legal and bonafide grievances of the students of these schools relating to serious violations of their right to education.

Instruction will effectively voice your concern for both your child and the other students in the class. Not only is school name_____failing our students, he/she also reflects poorly on Ahmed as a whole.

In today’s global economy, our students simply cannot afford to lose a year of instruction because of one teacher’s poor performance.Swift action must be taken so our children do not fall any farther behind.Please contact me so we can discuss this matter further. Letter of complaint about a school policy

Dear Mr. 

I am writing to voice my displeasure with a dangerous and disruptive policy at the Senior High School. I am referring to the mad noontime dash of seniors driving to pick up lunch.

I don't see the value in allowing seventy teenagers to get in their cars in the middle of the day, dash to a fast food establishment, and hurry back to the school. For those who don't leave, the drivers take orders and collect money, spending a considerable amount of time in class just planning for lunch.

The lunch time break only lasts for a 45 minute period. These young people are not experienced enough to handle all of the traffic and weather conditions they will encounter and still make it back in time for their first class of the afternoon. I believe this practice began as a reward for good grades and special achievements. Since then it has escalated to being considered an upperclassmen's right.

I feel that this was a bad idea in the first place and has only gotten worse over time. Students should be concentrating on their class work, not on racing to the nearest McDonald's.

I would be happy to meet with you and the school board to discuss alternatives in this matter.
