Plea says poor students not given books, HC notice to govt

The Delhi High Court on Wednesday issued notices to the Delhi government, DDA and Land and Development Office to reply to a PIL demanding proper implementation of the provisions of the Right to Education Act to provide free books and uniforms to the children from economically weaker sections (EWS) in private unaided schools.
"Unaided private schools are not providing free books, uniform and other study material, which are entitlement of each and every student admitted in a school under provisions of Sections 3(2) and 12(1)(c) of Right of Children to Free and Compulsory Education Act," the plea filed by NGO Justice For All said.
The petition said the government had failed to ensure the creation of a District Admission Monitoring Committee (DAMC) to facilitate the admission of EWS students in the private unaided schools under Clause 7 of the Delhi School Admission Order (EWS Order) of 2011.
The DAMCs were to be created in all 12 districts in Delhi.
Taking the example of Pitampura, the NGO alleged that in the absence of a DAMC, people who were facing difficulties in getting their child admitted to schools were approaching the NGO for help.
The bench of Chief Justice D Murugesan and Justice Jayant Nath issued notice to the Delhi government and Director of Education and asked them to file a reply by August 7.
The plea also informed the court that over 410 schools in the capital were running on the public land allotted to them at highly concessional rates in the term of grants under provisions of Delhi Development Act, 1957, Nazul Land Rules, 1981, and Master Plans of Delhi. The petitioner said such schools are under contractual obligation to provide freeship to the specified percentages of students.
The plea also states that the amount given as reimbursement by the government was not enough to meet the actual expenditure of books, uniforms, other study material and teaching aids.
"Student are facing a lot of financial difficulties to continue their education, which sometimes result in the drop out from the school," the plea said, asking the court to direct the government to issue proper guidelines for providing free books and uniforms.
