I need your help sir, my niece is a student of Presentation Convent school and as she studied very hard she secured 8o% in Class X but the newly appointed Principal has refused to give her Commerce with Math provided has fulfilled all the norms what they asked before Boards during Pre-Boards, now she has undergone depression and the principal said ''go and get your admission done some where else''this is not acceptable as the girl fulfill all the criteria. Please help us my didi is very financial weak and can't afford new school admission charges and lawyers fees.

I am trying to admit a girl child of my locality to get her admission to a pvt. school. Since the vacant seats are fallen vacant and Dy.Director Edu. Office of New Delhi & Central are not accepting the RTE Forms. There are 59 seats vacant in New Delhi Zone 26 & 8 Seats for Central Delhi for Nursery. But they are saying no seat vacant.

Subject: Lakhs of workers in Delhi denied statutory minimum wages

Dear Arvind ji, 

Trade Unions have gone for all India strike on September 02 demanding minimum wage of Rs.15000/- per month. Presently, minimum wages for unskilled worker in Delhi is 9048/- pm. However, on average, male worker is paid Rs.6000/- pm and female worker is paid Rs.5000/- pm. It is a crude exploitation of the lakhs of workers in Delhi affecting their standard of living. Labour Laws like ESI Act & Provident Fund Act etc. are also not implemented. 

It would be relevant to reproduce here under article 43 of the Constitution of India:- 

“Article 43 – Living wage, etc., for workers: The State shall endeavour to secure, by suitable legislation or economic organisation or in any other way, to all workers, agricultural, industrial, or otherwise, work, a living wage, conditions of work ensuring a decent standard of life and full enjoyment of leisure and social and cultural opportunities and, in particular, the State shall endeavour to promote cottage industries on an individual or co-operative basis in rural areas.”

Forget Living Wage. Forget Fair Wage. Here is a case where State has failed even to ensure minimum wages to the workers. Resultantly, workers are forced to live and work in inhuman conditions. The Hon’ble Supreme Court way back in 1983 in Asiad case held that payment of wages less than the statutory minimum wages attracts article 23 of Constitution of India that prohibits traffic in human beings and forced labour. If we go by this law, over 30% of the working population of Delhi could be easily termed as ‘Begar’. Our leaders talk of making Capital City of Delhi a Smart City. However, without making any endeavour to ameliorate the plight of this exploited lot, this idea of Smart City shall remain eluded.

Needless to remind you your promise made to the workers on the May-Day that AAP Government shall ensure payment of minimum wages to them and those found not paying the same would be sent to jail. To my knowledge, till date, no employer has been sent to jail for failure to pay minimum wages to its workers. Why Delhi Govt is silent?

Madam, We are bringing a shocking incident to your notice where an unaided recognized private school on public land has given a cruel and inhuman treatment to 7 years old class II EWS student. It is submitted that Shri Dayanand Jha (M-9213775630) r/o 12/12, Geeta Colony, Delhi-31 has complained to me that his 7 years old son Master Harsh Jha has been studying in St. Lawrence Convent Sr. Secondary School, Geeta Colony Facility Centre, Delhi-31 (Phone 011-22046100, 011-22056100) in Class II under EWS category. He stated that on 17th August 2012, around 11.30 am he received a call on his mobile from the school asking him to come to the school immediately and take his son Master Harsh back to home. It is submitted that the school did not tell the reason to the father. However, the father immediately reached to the school and found his son sitting at the reception with spoiled short. On enquiry, Master Harsh told him that he asked his teacher to permit him to go to washroom but his teacher did not allow him. As he could not control the same, he eased himself in the short. No one attended him. On the other hand, he was brought to the reception and made to wait for his parents. Letter dated 20.8.2012 of the parent is attached hereto for your ready reference. It is submitted that the aforesaid cruel and humiliating treatment was given to Master Harsh only because he belongs to EWS category. Master Harsh had earlier also complained to his father that the class teacher did not permit him to go to washroom whenever he made a request for the same. It is submitted that this school has been harassing and humiliating the EWS students/parents one way or the other right from very beginning and number of complaints have been made in this regard to the Director of Education from time to time. It is a different thing that the Director of Education has not taken any appropriate action against the school management. It is submitted that the cruelty and the humiliation to the EWS students by the school is not only unethical, illegal, unjust, anti-child, contrary to the provisions of RTE Act, 2009 but also violate the very philosophy of the Constitution of India. It is a case of apartheid. It is submitted that the school management has no moral or legal right to run the school. Therefore, it is, submitted that the public land allotted to this school should have been taken back by the Government of NCT of Delhi/DDA on account of continuous breach of the land allotment conditions. It is, therefore, requested that appropriate action may be taken against the school ensuring that the school must stop cruel and inhuman behavior towards the EWS students/parents. With regards,
