Subject: Information regarding road manjeera, road construction works at some colonies in Nizampet.

2.Information Requested:
2.1 All the below questions are with respect to Manjeera & Road Construction works in the following colonies between 01-Jan-2005 to 05-Oct-2012.
* Venkatraya Nagar Colony, Nizampet, Qutbullapur Md, RR Dt.
* Konalu Narayana Reddy Colony, Nizampet, Qutbullapur Md, RR Dt.
* Gayatri Gardens, Nizampet, Qutbullapur Md, RR Dt.
* Srinivasa Colony, Qutbullapur Md, RR Dt.
* Madhuranagar Colony, Qutbullapur Md, RR Dt.
a) In which of the above colonies the Manjeera water connection is available?
b) In which of the above the Manjeera water connection work is in progress? What is their expected completion date?
c) In how many colonies the Manjeera water connection work is not started yet? What is the expected start date expiration day?
d) From 01-Jan-2005 to 05-Oct-2012, how much money was spent for roads rennovation in each of these colonies?
e) As on 05-Oct-2012, what are the unstarted & proposed road construction/extension/repair works in the above colonies?
f) From 01-01-2008 to 05-Oct-2012, how much money was spent in establishing, repairs, rennovation for the road from “Pragathi Nagar colony, Qutbullapur to Rajeev Gruhakalpa, Nizampet”?
e) For the question-f name each work, and amount spent on it.
2.2 Name, Designation and Office Address of the SPIO/CPIO replying to this Application
2.3 Please inform me of the Name, Designation and Office address of the First Appellate Authority. Also, please inform me of the details of fees to be paid for First Appeal.
I request you to follow Section 7(3) of the RTI Act 2005 for providing information/providing with photocopies of supporting documents related to the information requested above.

4.Below items (4.1 to 4.13) are for your kind information and consideration:
4.1As per section 6(3) of the RTI Act 2005, In case, the requested information is held by another public authority, I request the PIO to transfer the application or part of it within FIVE days and immediately inform me about such transfer.
4.2As per section 7(3) of the RTI Act 2005, In case, there are further fee required to provide the requested information, I request the PIO to inform me of the additional fee amount along with the calculations made to arrive at the amount.
4.3As per section 5(3) of the RTI Act 2005, I request the PIO to provide assistance in getting the requested information.
4.4As per section 7(9) of the RTI Act 2005, I request the PIO to provide the requested information in the form in which it is sought.
4.5As per section 7(1) of the RTI Act 2005, I request the PIO to provide the requested information within 30 days.
4.6As per section 7(8)(iii) and 7(3)(ii) of the RTI Act 2005, I request the PIO to inform me of the particulars of First Appellate Authority.
4.7As per section 10(2) of the RTI Act 2005, In case the requested information is exempt from disclosure by any other law, I request you to provide that part of the record which does not contain any information which is exempt from disclosure under RTI Act 2005. FYI: “The RTI Act has over-riding effect vis-à-vis other laws inasmuch as the provisions of the RTI Act would have effect notwithstanding anything inconsistent therewith contained in the Official Secrets Act, 1923, and any other law for the time being in force or in any instrument having effect by virtue of any law other than the RTI Act “
4.8As per section 7(8) of the RTI Act 2005, In case of rejection of my application, I kindly request you to provide the reason for such rejection and not just quote a section of RTI. Also, I request you to provide the details of Appellate authority.
4.9As per section 8 (1) (j) of the RTI Act 2005, “… the information which cannot be denied to the Parliament or a State Legislature, shall not be denied to any person.”
4.10As per section 8(2) of the RTI Act 2005, “Notwithstanding anything in the Official Secrets Act, 1923 nor any of the exemptions permissible in accordance with sub-section (1), a public authority may allow access to information, if public interest in disclosure outweighs the harm to the protected interests.”
4.11As per section 7(2) of the RTI Act 2005, In case of no decision received within 30 days, the PIO shall be deemed to have refused the request.
4.12As per section 6(2) of the RTI Act 2005, “An applicant making request for information shall not be required to give any reason for requesting the information or any other personal details except those that may be necessary for contacting him.”
4.13As per section 7(6) of the RTI Act 2005, “Notwithstanding anything contained in sub-section (5), the person making request for the information shall be provided the information free of charge where a public authority fails to comply with the time limits specified in sub-section (1).”
4.14As per section 19(5) of the RTI Act 2005, “In any appeal proceedings, the onus to prove that a denial of a request was justified shall be on the Central Public Information Officer or State Public Information Officer, as the case may be, who denied the request”

Dear Sir,
Under the RTI Act 2005, please provide me following information
1. How many numbers of road are proposed to connect the SKP Colony (Babu Jagjivan Ram Ward) to Roshan Nagar( Rafi Ahmed Kidwai Ward)?
2. What are proposed width of the roads between SKP Colony to Roshan Nagar and what is the present status of the width of all the roads?
3. Is there any encroachment on the roads connecting SKP colony (Babu Jagjivan Ram Ward) to the Roshan Nagar(Rafi Ahmed Kidwai Ward) ?If yes ,name of the encroachers along with there addresses.
4.List of khasra numbers of the Roshan Nagar Area(Rafi Ahmed Kidwai ward) those are valid as per the records of Municipal Corporation Katni.

Subject: Application for Information under Right to Information Act 2005
I, Kamal Kishore, a citizen of India, request you to kindly provide me the following information under the Right to Information Act, 2005:
1)      Please inform me the Name, Designation, Address, Office Telephone number of the Officer of the Municipal Corporation of Gurgaon or the related Institution, who is responsible for the maintenance of Roads located in U-Block, DLF Phase-3 (Behind Cyber Greens), Gurgaon. I am particularly concerned about the road which goes from RBS Building towards Basement Market of U-Block and street U-79.

2)      How often and with what frequency is the above mentioned officer supposed to carry out inspection of the roads and check their condition?

3)      When was the last date and time when the officer carried out an inspection of the roads located in U-Block, DLF Phase-3?

4)      Please provide me with a certified copy of the Action Taken Report based on the inspection report made by the officer after inspecting the roads in U-Block, DLF Phase-3 area.

5)      Please give a list of all the works related to improvement of roads and streets carried out in this area during the period from Jan 2010 to June 2011.

6)      How many times have repairs (both minor and major) been carried out on each road and street in this area?For each repair work, the list should contain:

a)      The length of the street or the road repaired and identify the starting and the ending point  by house
b)      Numbers or other methods (like a small hand drawn sketch)
c)      Exact location of spots where the work was carried out
d)     The name of the work
e)      Work order no.
f)       Length of repair
g)      Average width of repair
h)      Method of repair
i)        What was the composition of repair
j)        Actual date of start
k)      Actual date of completion
l)        Amount paid or payable
m)    Status of work
n)      Name of the contractor
o)      Mode of improvement of that road or street

7)      After you have prepared the above information, I would like to inspect your measurement books and work order registers related to these works to ensure that you have given complete information. Please let me know a date and time and the venue where I can come for inspection.

8)      The roads are totally broken these days. Please give specific reasons for the bad condition of each of these roads separately in a table format stating Name of the road, starting and ending point and the reason for poor condition.

9)       If any of the roads is broken due to water stagnation on the road, please intimate whether it is due to wrong design, wrong execution, poor quality material or due to clogged drains or any other reason?

10)   If it is due to wrong design, wrong execution, poor quality materials, how was the payment passed?

11)   What action will be taken against the engineer who inspected the road and let it pass like this?

12)  If it is due to clogged drain, please provide the following information from the concerned department which dealt with it:
a)      When were these drains cleaned during the stated period?
b)      Give copy of the measurement book of the cleaning carried out?
c)      Provide the names of the officials who inspected and passed the payments. This means that these officials did not do their job properly. Their inaction has caused so much loss to the exchequer and so much inconvenience to the public. They are also guilty of criminal misconduct under the Prevention of corruption Act.
d)     By when will action be taken against them and what action will you take?

13)  The fact that these roads have broken shows that very bad material has been used in the roads. What enquiries will be made to ascertain the quality of the roads? How will you fix responsibilities? By when the enquiries will be completed?

14)  The payments seem to have been done fraudulently and the inspection carried out by the engineers was faulty. What enquiries will be instituted against the engineers who passed the payments and did faulty inspection?

15)  How many written or verbal complaints has the Municipal Corporation of Gurgaon or the related Institution received regarding the poor conditions of Roads in the U-Block, DLF Phase-3 Area? Please give me the following information about each of the complaints:
a)      Date of complaint
b)      Daily progress of the complaint received
c)      Action taken on the complaint received
d)     Date of reply given to the complainant and a copy of the reply

16)  By what date can the citizens living in U-Block, DLF Phase-3 area expect the roads to be restored to their original conditions and be made fit for normal driving?
17)  If the roads are not restored to their original conditions by the date indicated in Item 15 above, what action will be taken and what penalties will be levied by Council/Corporation against the officers/ contractors/ agencies which do not restore the road on time?

I am attaching the receipt of the payment of application fees for this RTI Application. I am willing to pay any further charges as decided by the PIO and communicated to me with a reasoned written order, giving detailed calculations for arriving at the additional charges so requested by the PIO.

1. During the period 1.4.2009 to 31.08.11, please indicate the number of times have repairs (both minor and major) been carried out on above road?
2. If the work was done departmentally, please provide the following information with respect to each such work:
a. Copy of relevant portion of stock register
b. Copy of relevant portion of labour register
c. Exact location of spots where the work was carried out
d. When was the work carried out
e. What was the method of repair?
f. Please provide me the details of the exact composition of material used?
3. If the work was done through a contractor or State owned company, please provide the following information with respect to each such work:
a. Copy of measurement book (both abstract entries & record entries)
b. Copy of sketch
c. Copy of details of estimates
d. If there was any guarantee clause in the contract, copy of that portion of the contract which mentions this guarantee clause and the conditions in which this clause can be invoked.
e. Names of the Assistant Engineer and the Executive Engineer who inspected each of these works and passed payments. Please provide the details of the portions of the works that were inspected by them?
f. Has the guarantee clause been invoked till now? If no, why despite the fact that the roads are in such bad condition.
4. The road is totally broken these days between Toll Collection Counter(Right before ELCOT Main gate) and Pudunagar Bus Stand (After Perumbakkam Bus Stand). Please give reasons for the bad condition of the road(Please mention specific reasons separately).
5. If road is broken due to water staying on the road, please intimate whether it is due to wrong camber or due to clogged drains? If not both, please indicate the exact reason.
6. If it is due to wrong camber how was the payment passed? What action will be taken against the engineer who inspected the road and let it pass like this?
7. If it is due to clogged drain, please provide following information from other department which dealt with it:
a. When were these drains cleaned during the above period?
b. Give copy of the measurement book of the cleaning carried out?
c. Please provide the names of the officials who inspected and passed the payments.
9. Please provide the exact date of completion of this road, as per the current plan
