Subject: Information sought under RTI Act, 2005.
Madam/Sir,
Keeping in view of the Office Memorandum No. 36011/1/2011-Estt (Res) dated 17th November 2011 of the Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training) in connection with issuing a Brochure on Reservation for the Scheduled Castes, Scheduled Tribes and Other Backward Classes in services on the DoPT website www.persmin.nic.in and forwarding a hard copy to the all Government offices in India, please provide the information on the following points within 30 days as mandated under RTI Act, 2005:
Q 1. Whether the Lok Sabha Secretariat have received and adopted ‘Brochure on Reservation for the Scheduled Castes, Scheduled Tribes and Other Backward Classes in services’? If not, please state the reasons for not adopting the same.
Q 2. As per the Office Memorandum No. 36011/1/2011-Estt (Res) dated 17th November 2011 of the Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training), it has now mandatory in order to keep and eye on the Institutional Safeguards of SC/ST that each Ministry / Department is required to nominate officers of the rank of Deputy Secretary or above to work as Liaison Officer who take care of implementation of instructions relating to special representation of SC/ST in their respective Ministries/Department and attached, subordinate offices. The system of nominating Liaison Officers has also been extended to the offices under the Heads of Departments also.
Please provide the details of the Liaison Officer nominated for SC/ST in Lok Sabha Secretariat. If Liaison Officer is not appointed yet, please provide the reasons for overlooking such important matter and not following the clear guidelines issued by DoPTvide Office Memorandum No. 36011/1/2011-Estt (Res) dated 17th November 2011 of the Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training) ‘Brochure on Reservation for the Scheduled Castes, Scheduled Tribes and Other Backward Classes in services’?
Q 3. In case of cadres having more than 13 posts, all appointing authorities should maintainReservation Registers in the format given in Annexure-I of the ‘Brochure on Reservation for the Scheduled Castes, Scheduled Tribes and Other Backward Classes in services’.
Please provide the details, if the Lok Sabha Secretariat have prepared Reservation Registers in the format given in Annexure-I of the Chapter -5 of ’Brochure on Reservation for the Scheduled Castes, Scheduled Tribes and Other Backward Classes in services’ posted on the DoPT website www.persmin.nic.in . If yes, please provide a certified copy of it. If not, please provide the reasons for not preparing it and ignoring such important administrative matter.
Q 4. SC and ST candidates in case of promotion, appointed on their own merit and not owing to reservation should not be shown against reserved quota. They will be adjusted against unreserved quota. But SC/ST candidates appointed on their own merit (by direct recruitment or promotion) and adjusted against unreserved points will retain their status of SC/ST and will be eligible to get benefit of reservation in future/further promotions, if any.
Please provide the details whether the above rule is implementing adhere in Lok Sabha Secretariat. If not, please provide the reason for not implementing the above rule.
Q 5. As per the Office Memorandum No. 36011/1/2011-Estt (Res) dated 17th November 2011 of the Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training), it has now mandatory in order to keep and eye on Monitoring and Institutional Safeguards of employees belong to SC/ST community, that soon after the first of January of every year, each Appointing Authority shall send to its administrative Ministry/Department:-(i) SC/ST/OBC Report-I in the proforma given in Annexure-I of the above -said OM of DoPTshowing the total number of Government servants and the number of SCs, STs and OBCs amongst them as on the 1st January of the year and the number of appointments made during the preceding calendar year alongwith the number of SCs, STs and OBCs amongst them; and (ii) SC/ST/OBC Report-II in the proforma given in Annexure-II of the above -said OM of DoPT showing the representation of SCs, STs and OBCs in various grades of organised Group ‘A’ services as on the I’ January of the year and the particulars of recruitment to the various grades during the preceding calendar year in the service.
Please provide the information, if the above rule is implementing in Letter and Spirit in the Lok Sabha Secretariat or not. If not, please provide the reasons in this regard. Also please provide the Name and Designation of Non-Gazetted employees (LAFEA and Clerical only) belong to SC & STs community in Lok Sabha Secretariat providing the information relating to shortfall of SC/ST representation in each post of non-gazetted employees as on date.
Q.6 As it now become mandatory to depute one officer not below the rank of Deputy Secretary in the Ministry/Department who will act as a Liaison Officer in respect of matters relating to the representation of Scheduled Castes and Scheduled Tribes in all establishments and services under the administrative control of the Ministry/Department.
Please provide the details of the Liaison Officer for ensuring reservation norms, representation of SC/ST, grievances, welfare etc. in the Lok Sabha Secretariat.
Q.7 As per the Office Memorandum No. 36011/1/2011-Estt (Res) dated 17th November 2011 of the Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training), it has now mandatory to set up a Reservation Cell within the Ministry/Department under the direct control of the Liaison Officers. The functions of the Cell will mainly be to assist the Liaison Officers to discharge their duties effectively.
Please provide the details of the action taken by the Administration in order to set up a Reservation Cell in Lok Sabha Secretariat. If no action has been taken in the regard, please provide the reasons for ignoring such important matter, even after it has become mandatory.
Q.8 Please provide the details if there is any case pending with the Administration in connection with negligence or lapses in the matter of following the reservation and other orders relating to Scheduled Castes and Scheduled Tribes coming to light through the inspections carried out by the Officer concerned or otherwise. Please provide the detailed information, if such incident has been reported to the Speaker, Lok Sabha and/or Secretary General, Lok Sabha?
I am writing this application for you to help me to file an RTI. I live in Hong Kong, and have been involved in IAC movement actively. Recently visited India, and found that in my hometown there is a bridge which is under construction since so many years, and there has been huge diesel oil theft and other financial irregularities in bridge construction. So far, there are just 14 pillars build, and construction has been stopped without any public information, there is not even a project information board at site which is mandatory. This bridge (of length more than 1 KM) could a be great advantage for local people, business class and will be a big improvement from Infrastructure point of view, which is expected to be build on Ganga River, Jamania Town, Distt. Ghazipur.
I tried collecting some information by myself. With reference to above tabled information, UP State Bridge Corporation, as on 02/ 2008, they have given this information on their website. The current situation is that, there is no construction work going on. I could have tried doing it through RTI Nation, but since I am not India, thought RTIA could be a good way out. In context of above I want to have following information from the UP State Bridge Corporation:
1. What is the start date of work, and with what budget the construction work was started. along with Budget Forecast and actual expenses? Let me know the different payment milestones, how much payment has been made so far against what item in construction of this bridge?
2. Can you please share the initial proposal of this project before it was started that includes why this bridge needs to be build and what are the benefits this bridge may bring to the people who will potentially use it?
3. How many times the construction of the bridge had to stop and due to what reason?
4. Complete detail of daily expense report, monthly expense sheet and annual expense report?
5. What is the planned date of completion and what is expected date of completion?
6. How many people were working at the bridge site on peak time, how much petrol and diesel oil was being consumed on average each day…? And what was the activity which was making use of this petroleum Oil…?
7. Currently the construction is stopped, what is the reason and can you please share the high level project plan, contact details of all the key person involved in this construction work with their roles and responsibilities?8. There is a pillar which was half build and left afterwards, at the end of Kankarhwa Ghat, in Jamania end, what is the reason behind not completing this pillar? Was it a human mistake..? If yes, why was it not judged properly before construction started, how much money is wasted in this partially build pillar…?
